Are You Guaranteed Help? Why Some Attorneys Refuse Motorcycle Accident Cases

When you are in a motorcycle accident, you may find it more difficult to find an attorney to help you than you would think. There are some lawyers that will not take on a motorcycle case even if it seems to be a slam dunk case. The following are some reasons why it could be hard to find an attorney to represent you after a motorcycle accident.

Not Specialized

Most attorneys have one or more fields of expertise in which they specialize. While auto accident attorneys are common, many do not specialize in motorcycle accidents as well because they are completely different than cars or other vehicles. Those that specialize in personal injury could still decline to represent you because they do not take any vehicle accidents.

You Are the Cause of the Accident

If an attorney finds out that you were the primary cause of the accident, he or she may not want to take you as a client. If you are only partly to blame, that may help you since you will have a leg to stand on legally.

You Did Not Get Medical Attention

If you did not go to the hospital after your accident, it is possible that an attorney is less likely to help you. One of the best types of evidence is medical records detailing your injuries. The type of injuries sustained, the treatment needed, and the cost of your medical care are all important parts of winning a motorcycle accident case. If you have none of that evidence, the attorney may not be willing to do the extra work of trying to prove your case.

Uninsured Motorist

If the other party at fault is not insured, it can be problematic for you. When you bring a case against a person who is not insured to drive and win, chances are they could file bankruptcy to get out of paying the claim. This ends up being bad for both you and your attorney, as neither of you will be paid.

Keep in mind that if one attorney chooses not to work with you on your motorcycle accident case, that does not necessarily mean no one will. You will have to make appointments and seek referrals with several attorneys where you live until you find the right one for your case. There is someone out there who will be willing to help you, but you need to be ready to do all you can to help demonstrate that your case is worth it.

The paperwork is overwhelming in itself, and it was hard for my husband and I to understand all the legal jargon.
